Terms of Service

These Terms of Service ("Terms") are an agreement between you and TapClaim ("TapClaim", "we", "us") and govern your use of the TapClaim iOS app and the website at https://tapclaim-legal.ever-code.co (together, the "Service"). Please read them — they contain important disclaimers about what TapClaim does and does not do.

1. Who We Are and Acceptance of These Terms

TapClaim is an iOS app for users in the United States that helps you discover class-action settlements you may qualify for and track claims you have filed. By downloading, installing, or using TapClaim, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. You must be an adult (at least 18 years old) to use TapClaim.

2. What TapClaim Is — and What It Is Not

TapClaim is not a law firm and does not provide legal advice. Nothing in the app is legal advice, and using TapClaim does not create an attorney-client relationship. For advice about your legal rights, consult a licensed attorney.

TapClaim guarantees nothing: not that you are eligible for any settlement, not that any claim will be approved, not any payment amount, and not any payment timing. Eligibility and any award amounts are determined solely by settlement administrators and courts — not by TapClaim. Payments are not guaranteed, amounts vary, and timing is outside our control.

TapClaim is an independent information and convenience tool. We are not affiliated with, endorsed by, sponsored by, or acting on behalf of any court, settlement administrator, class counsel, defendant, or other party to any class-action settlement. If you have questions about the status of a claim you filed or about a payment, contact the settlement administrator for that settlement — we cannot answer them.

3. How the Service Works

TapClaim aggregates publicly available information about U.S. class-action settlements. A short onboarding quiz, your U.S. mailing address, and optional per-settlement eligibility questions (simple yes/no answers) are used to suggest settlements you may qualify for and to help you track claims you have filed.

A match is a suggestion, not a decision. A match or eligibility indication in TapClaim means only that, based on your answers and public settlement criteria, you may qualify. It is not a determination of eligibility; only the settlement administrator and the court decide who is eligible.

You file claims yourself. When you choose to file a claim, TapClaim opens the settlement administrator's official claim form in an in-app browser. You submit the claim yourself on that third-party website. TapClaim does not file claims on your behalf, is not a party to any settlement, and does not process, hold, or distribute any settlement payments.

4. Settlement Information: Accuracy, Timeliness, and Completeness

Deadlines, eligibility criteria, and settlement terms are set by courts and settlement administrators and can change at any time. Our information may contain errors or be out of date, and we do not list every settlement. Always verify details on the official settlement website before filing a claim. We may add, change, or remove listed settlements at any time.

5. Payment Amounts and Timing Are Estimates

Payment amounts shown in the app are estimates based on publicly available settlement documents and are typically maximums ("up to $X"). Actual payments depend on the number of valid claims filed, the proof you provide, and court approval, and are often substantially lower than the "up to" figure — sometimes zero. Payout timing shown in the app is also an estimate; actual timing is controlled by the court and the settlement administrator and can take months or years.

7. Subscriptions and Billing

TapClaim offers auto-renewing subscriptions — a weekly plan and an annual plan — purchased as in-app purchases through the Apple App Store. Prices are shown in the app before you purchase.

Your subscription pays for convenience, not access to settlements. It pays for discovery, matching, and tracking convenience. You can always file any settlement claim for free directly on the administrator's official website without TapClaim, and subscribing does not affect your eligibility for any settlement or any payment amount.

8. Accounts and Termination

Your TapClaim account is anonymous and device-based: a generated user ID, with no email or password login. Data tied to your account includes your U.S. mailing address, eligibility answers, claim tracking status, and subscription status, as described in our Privacy Policy.

You may stop using the Service at any time and may delete your account and data as described in the Privacy Policy. We may suspend or terminate your access to the Service if you violate these Terms, misuse the Service, or where required by law. We may also discontinue the Service or any feature; if we discontinue the Service entirely, your subscription remains subject to Apple's refund policies.

10. Intellectual Property

The TapClaim app, website, name, logo, and all content we create (excluding third-party settlement information and third-party trademarks) are owned by TapClaim and protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for your own non-commercial use in accordance with these Terms. Settlement names and company names shown in the app belong to their respective owners and are used only to identify the settlements; their appearance does not imply any affiliation or endorsement.

11. Third-Party Websites and Services

Settlement administrator websites — including the official claim forms TapClaim opens in the in-app browser — are third-party websites governed by their own terms and privacy policies. We provide these links as a convenience but do not control or endorse their content, availability, accuracy, security, or practices. Information you enter on a settlement administrator's claim form goes directly to the administrator; TapClaim does not receive, see, or store what you enter on those third-party websites.

The Service also uses third-party services (such as Apple, Google Firebase, RevenueCat, PostHog, Meta, and TikTok) for payments, analytics, subscription management, and ad attribution, as described in our Privacy Policy.

12. Apple App Store Terms

These Terms are an agreement between you and TapClaim, not with Apple Inc. ("Apple"). Apple is not responsible for the app or its content and has no obligation to furnish any maintenance or support for the app. Apple is not responsible for addressing any claims by you or any third party relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and consumer-protection claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the app must also comply with the Apple Media Services Terms and Conditions.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. TAPCLAIM DOES NOT GUARANTEE THAT ANY SETTLEMENT WILL BE LISTED, THAT ANY MATCH IS ACCURATE, THAT ANY CLAIM WILL BE AVAILABLE, ACCEPTED, APPROVED, PAID, PAID IN FULL, OR PAID ON TIME, OR THAT SETTLEMENT INFORMATION, DEADLINES, OR ESTIMATED AMOUNTS SHOWN IN THE APP ARE CORRECT, COMPLETE, OR UP TO DATE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAPCLAIM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE. WITHOUT LIMITING THE FOREGOING, TAPCLAIM IS NOT LIABLE FOR MISSED OR CHANGED DEADLINES, SETTLEMENTS NOT LISTED IN THE APP, INACCURATE OR OUTDATED SETTLEMENT INFORMATION, DENIED OR REJECTED CLAIMS, OR LOST OR REDUCED PAYOUTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAPCLAIM'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU; NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you in the app or on our website and update the effective date at the top of this page. Your continued use of the Service after a change takes effect means you accept the updated Terms; if you do not accept them, stop using the Service and cancel any subscription in your App Store settings.

16. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Türkiye. Disputes will be resolved in the courts of Istanbul, Türkiye, except that you keep any mandatory rights and venue protections granted by the consumer-protection laws of the place where you live.
